Terms of Service & User Agreement

This Terms of Service and User Agreement ("Agreement") is a legally binding contract between you ("User," "you," or "your") and Mahjong Hustlers ("Mahjong Hustlers," "we," "us," or "our"). By purchasing, accessing, or using any of our digital products or services — including online courses, digital downloads, and community access — you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.

 

If you do not agree to these terms, you must not purchase or access our products or services.

 

 

IMPORTANT NOTICE: PLEASE READ CAREFULLY BEFORE PURCHASING

Due to the immediate digital nature of our products, all sales are final. By completing your purchase, you agree to our no-refund policy as described in Section 7 of this Agreement.

1. Products and Services Covered

This Agreement applies to all of the following products and services offered by Mahjong Hustlers (collectively, the "Products"):

 

1.1  Online Courses: Mahjong Hustlers 101 and Mahjong Hustlers 102, including all video lessons, module content, quizzes, lesson materials, and any future updates or additions to course content delivered through our Kajabi platform.

 

1.2  Digital Downloads: All downloadable materials associated with our courses, including but not limited to reference guides, handouts, cheat sheets, glossaries, worksheets, and any other downloadable files made available to enrolled students.

 

1.3  Community Access: Access to the Mahjong Hustlers online community platform (hosted on Kajabi), including community discussion boards, member posts, live Q&A sessions, recorded Q&A sessions, and any other community features made available to bundle members.

 

Access to specific Products depends on the purchase tier selected at checkout. Individual course purchases include course content and digital downloads. The bundle purchase includes courses, digital downloads, community access, and live Q&A sessions. Community access and live Q&A sessions are exclusive to the bundle.

2. License and Permitted Use

Upon purchase and payment in full, Mahjong Hustlers grants you a limited, non-exclusive, non-transferable, revocable personal license to access and use the Products solely for your own personal, non-commercial educational purposes, subject to the terms of this Agreement.

 

2.1  What You May Do

• Access and watch course video lessons for personal learning
• Download digital materials for personal reference and use
• Participate in community discussions and Q&A sessions
• Take notes and apply concepts learned in your personal mahjong practice

 

2.2  What You May Not Do

The following are strictly prohibited and constitute a material breach of this Agreement:

• Share, transfer, sell, sublicense, or give your account or login credentials to any other person
• Reproduce, copy, duplicate, distribute, publish, broadcast, or publicly display any course content, video lessons, audio recordings, transcripts, or digital downloads, in whole or in part
• Record, screen capture, screenshot, or otherwise capture course video content or live Q&A sessions
• Upload, post, or share any course content or digital downloads on any website, social media platform, file-sharing service, or other medium
• Use course content or digital downloads to create or develop competing educational products, courses, or materials
• Resell or commercially exploit any portion of the Products in any manner
• Remove, obscure, or alter any copyright notices, trademarks, or other proprietary notices contained in or on the Products
• Use automated means (bots, scrapers, or similar tools) to access or collect content from the platform

3. Intellectual Property Rights

All content contained within the Products — including but not limited to video lessons, audio recordings, written materials, handouts, downloadable files, teaching methods, course structure, lesson scripts, graphics, and community content created by Mahjong Hustlers — is the exclusive intellectual property of Mahjong Hustlers and is protected by United States and international copyright law, trademark law, and other applicable intellectual property laws.

 

Your purchase grants you a personal license to access the Products as described in Section 2. No purchase transfers any ownership rights, copyright, or any other intellectual property rights to you.

 

The Mahjong Hustlers name, logo, course titles, and related branding elements are trademarks of Mahjong Hustlers. You may not use any of our trademarks or branding without our prior written consent.

 

Any unauthorized use, reproduction, or distribution of our content may result in immediate termination of your access and may subject you to civil and criminal liability under applicable law.

4. Community Guidelines

Access to the Mahjong Hustlers community is a privilege available to bundle members. By participating in the community, you agree to conduct yourself in a respectful, constructive, and lawful manner at all times.

 

4.1  Community Rules

• Treat all members and instructors with respect and courtesy
• Keep discussions relevant to mahjong, the course material, and related topics
• Do not share copyrighted content from our courses within the community
• Do not spam, solicit, advertise, or promote other products or services without prior written consent
• Do not post offensive, harassing, discriminatory, or otherwise objectionable content
• Do not share personal information of other members without their explicit consent

 

Mahjong Hustlers reserves the right to remove any content that violates these guidelines and to revoke community access for any member who repeatedly or egregiously violates these rules, without refund.

 

4.2  User-Generated Content

By posting content in the community, you grant Mahjong Hustlers a non-exclusive, royalty-free license to use, display, and share your posts within the platform. You retain ownership of your original content. You represent that any content you post does not infringe upon the intellectual property rights of any third party.

5. Account and Access

Your account is for your personal use only. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [contact email] if you suspect unauthorized access to your account.

 

Mahjong Hustlers reserves the right to suspend or terminate your account and access to all Products if we determine, in our sole discretion, that you have violated any provision of this Agreement. In the event of termination for cause, no refund will be issued.

 

We reserve the right to modify, update, or discontinue any Product or feature at any time. We will make reasonable efforts to notify enrolled students of material changes to course content.

6. NMJL Card and Third-Party Materials

Our courses teach students how to play American Mahjong and how to read and interpret a mahjong card in general terms. Our courses do not reproduce, display, or distribute the National Mah Jongg League (NMJL) card or any specific hands from the NMJL card.

 

Students are required to independently purchase a current NMJL card directly from the National Mah Jongg League at nationalmahjongLeague.org. The cost of the NMJL card is not included in your course purchase and is the sole responsibility of the student.

 

Mahjong Hustlers is an independent educational provider and is not affiliated with, endorsed by, or officially connected to the National Mah Jongg League in any way.

7. Refund Policy

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS ON ANY OF OUR DIGITAL PRODUCTS.

Due to the immediate nature of digital product delivery, all purchases of Mahjong Hustlers courses, digital downloads, and community access are non-refundable. Upon completing your purchase, you immediately gain access to the purchased content — this immediate access is the basis for our no-refund policy.

 

By completing your purchase, you expressly acknowledge and agree that:

• You have read and understood this no-refund policy prior to purchase
• You are purchasing a digital product to which you receive immediate access
• The immediate delivery of digital content makes a refund impractical and inequitable
• No refund will be issued regardless of whether you have accessed, partially accessed, or not accessed the content
• No refund will be issued if you are dissatisfied with the content after accessing it
• No refund will be issued if you no longer have a use for the content

 

If you have a technical issue preventing access to content you have purchased, please contact us at [contact email] and we will make every effort to resolve the issue promptly. Technical support is not a basis for a refund but will be addressed in good faith.

 

In the rare event that a course is permanently discontinued and you have not yet been able to access purchased content, we will evaluate refund requests on a case-by-case basis at our sole discretion.

8. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

 

We do not warrant that:

• The Products will meet your specific learning objectives or expectations
• The platform will be uninterrupted, error-free, or free from technical issues
• The information contained in the Products is complete, accurate, or current at all times
• Access to live Q&A sessions will always be available at the scheduled time

 

Mahjong Hustlers is an independent educational provider. We make no guarantees about your improvement in mahjong skill as a result of taking our courses. Individual results will vary.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAHJONG HUSTLERS, ITS OWNERS, INSTRUCTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

In no event shall our total liability to you for all claims arising out of or related to this Agreement exceed the total amount paid by you for the specific Product giving rise to the claim in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mahjong Hustlers and its owners, instructors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of any provision of this Agreement
• Your unauthorized use, reproduction, or distribution of any course content or digital downloads
• Your violation of any applicable law or regulation
• Any content you post in the community that infringes upon the rights of a third party
• Any claim by a third party arising from your use of the Products

11. Copyright Infringement and DMCA

Mahjong Hustlers takes copyright infringement seriously. If you believe that any content in our Products infringes upon your copyright, please contact us at [contact email] with the following information:

• A description of the copyrighted work you claim has been infringed
• The specific location of the allegedly infringing content
• Your contact information
• A statement that you have a good faith belief the use is not authorized
• A statement, under penalty of perjury, that the information you provide is accurate and that you are the copyright owner or authorized to act on the owner's behalf

 

We will respond to valid DMCA notices promptly and take appropriate action in accordance with applicable law.

 

If you are found to be infringing upon Mahjong Hustlers' copyright — including but not limited to unauthorized sharing, reproduction, or distribution of course content — we reserve the right to immediately terminate your access to all Products, pursue injunctive relief, and seek damages to the fullest extent permitted by law.

12. Legal Protections — What We Prepare For

The following outlines the primary legal considerations that govern your use of our Products and our ability to protect our business. This section is informational and does not limit any other rights or remedies available to us under this Agreement or applicable law.

 

12.1  Copyright Infringement

Our course videos, scripts, handouts, and teaching materials are registered or registerable works protected by the U.S. Copyright Act. Unauthorized reproduction or distribution may result in statutory damages of up to $150,000 per work infringed (for willful infringement), plus attorneys' fees, under 17 U.S.C. § 504.

 

12.2  Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute with your bank or credit card provider after receiving access to our Products, we reserve the right to (a) provide evidence of this Agreement and your acknowledgment of the no-refund policy to the payment processor, (b) terminate your account and access permanently, and (c) pursue any balance owed through collections. We document all access and purchase records for this purpose.

 

12.3  Unauthorized Account Sharing

Account credentials are for a single user only. If we detect multiple simultaneous logins or other evidence of account sharing, we reserve the right to immediately terminate the account without refund and, if appropriate, pursue legal action for breach of contract.

 

12.4  Defamation and False Claims

We reserve the right to take legal action against individuals who make false, defamatory, or malicious public statements about Mahjong Hustlers, its instructors, or its Products that cause harm to our business or reputation.

 

12.5  Platform Terms

Our Products are delivered through Kajabi. Your use of the Kajabi platform is also subject to Kajabi's own Terms of Service and Privacy Policy. We are not responsible for Kajabi's platform performance, outages, or policy changes.

13. Privacy and Data

By purchasing and using our Products, you consent to the collection and use of your personal information as described in our Privacy Policy, which is incorporated into this Agreement by reference. Our Privacy Policy is available at [website URL].

 

We collect only the information necessary to provide you with access to your purchased Products, process your payment, and communicate with you regarding your enrollment. We do not sell your personal information to third parties.

14. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

 

Any dispute, claim, or controversy arising out of or relating to this Agreement or the Products shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to binding arbitration in Harris County, Texas, in accordance with the rules of the American Arbitration Association.

 

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

 

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm, particularly in cases of intellectual property infringement.

15. Modifications to this Agreement

Mahjong Hustlers reserves the right to modify this Agreement at any time. We will notify active enrolled students of material changes by email or by posting a notice on the platform. Your continued use of the Products after the effective date of any modification constitutes your acceptance of the updated Agreement.

 

It is your responsibility to review this Agreement periodically. The current version of this Agreement is always available at [website URL/terms].

16. General Provisions

Entire Agreement: This Agreement constitutes the entire agreement between you and Mahjong Hustlers with respect to the Products and supersedes all prior agreements, representations, and understandings.

 

Severability: If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

 

No Waiver: Our failure to enforce any provision of this Agreement shall not constitute a waiver of our right to enforce such provision in the future.

 

Assignment: You may not assign or transfer your rights under this Agreement to any other person. Mahjong Hustlers may assign this Agreement without restriction.

ACKNOWLEDGMENT

BY PURCHASING ANY MAHJONG HUSTLERS PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT IN ITS ENTIRETY, UNDERSTAND ITS TERMS, AND AGREE TO BE BOUND BY IT. YOU FURTHER ACKNOWLEDGE THAT THIS AGREEMENT CONTAINS A NO-REFUND POLICY AND THAT ALL SALES ARE FINAL.

 

If you are purchasing on behalf of an organization or third party, you represent that you have the authority to bind such organization or third party to this Agreement.
